Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kastyn ("Service"), operated by Cre8iveMonk ("we", "us", "our"), a sole trader based in Birmingham, United Kingdom. By registering for or using the Service you agree to be bound by these Terms.

1. The Service

Kastyn is a broadcast metadata infrastructure platform that automatically identifies, corrects, and manages music metadata for internet radio stations, DJs, and streaming platforms. The Service includes a web dashboard, REST API, desktop agent software, and related tools.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Service. By creating an account you confirm that you meet these requirements.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at hello@kastyn.co.uk if you become aware of any unauthorised access to your account. We are not liable for losses resulting from unauthorised use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload or process content you do not have the right to use
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Use automated means to access the Service in a way that exceeds normal usage
• Resell or sublicense access to the Service without our written consent
• Interfere with or disrupt the integrity or performance of the Service

5. Subscription and Billing

Kastyn offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually in advance. All prices are in GBP and inclusive of VAT where applicable. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are issued at our discretion within 14 days of a charge if the Service has not been materially used.

6. Your Content

You retain ownership of all music files and metadata you process through the Service. By using the Service you grant us a limited, non-exclusive licence to process your content solely for the purpose of providing the Service. We do not claim ownership of your content and will not share it with third parties except as required to operate the Service (e.g. fingerprinting via AcoustID).

7. Intellectual Property

The Kastyn platform, including its software, design, trademarks, and documentation, is owned by Cre8iveMonk. Nothing in these Terms grants you any right to use our intellectual property outside of normal use of the Service.

8. Third-Party Services

The Service integrates with third-party services including AcoustID and MusicBrainz for audio fingerprinting and metadata lookup. Use of these services is subject to their own terms and policies. We are not responsible for the accuracy of third-party metadata.

9. Availability and Modifications

We aim to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, that metadata corrections will be accurate, or that the Service will meet your specific requirements.

11. Limitation of Liability

To the maximum extent permitted by law, Cre8iveMonk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

12. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately for breach of these Terms. Upon termination your data will be retained for 30 days before deletion, during which time you may export it.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email or via an in-dashboard notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
